Govt forms Regulatory Reforms Commission

THE caretaker government in a major policy development on Tuesday formed a 17-menber regulatory reforms commission for updating the centuries-old rules and regulations of the country to infuse dynamism into governance, administration and the economy.

A government notification said the commission had been constituted with a chairman and 16 members on part-time assign-ment.

Explaining the urgency of forming the reform commission, the government said, ‘In the present era of globalization and regional cooperation the huge numbers of existing rules of the country are not suitable foe a dynamic administration.

‘Specially the rules related to country's economic investment, commerce and trade are complex and fraught with Procrastination Hence, modernisation of the rules is an imperative for expediting the economie development.

Under these circumstance said the notification the Regulatory Reforms Commission has been formed for preparing recommendations aiming to make the existing rules and regulations modern and time-worthy after necessary reform and review.

Former adviser of the previ-ous caretaker government Akbar Ali Khan has been appointed chairman of the RRC, which came into being at a time when the interim regime has been car-rying out massive socio-political reforms against the backdrop of the recent political crisis.

The members are former advisers Abdul Muyeed Chowdhury and Manjur-e-Elahi, incumbent cabinet secretary, gov-crnor of the Bangladesh Bank, secretary of the establishment ministry, secretary of finance divi-sion of finance ministry, home secretary, law, justice and parlia-mentary affairs secretary, com-merce secretary, environment and forest secretary, NBR chair-man, executive chairman of the BOI. President of FBCCI , MA Rouf Chowdhury, chairman MARK group, Hossain Zillur Rahman, executive chairman of PPRC, and Mostafizur Rahman, executive chairman of the CPD.

The tenure of the commission would be one year from the date of issuing of the notification.

As per its scope of work, the commission can co-opt any expe-rienced person for accomplishing its task for a particular period for particular purpose mentioned in the notification. The government then will incorporate that person by gazette notification.

The Board of Investment will carry out secretarial function of the commission while the BOI executive chairman act as mem-ber-secretary to the RRC.

The commission's adminis-trative ministry well be at the chief Adviser's office while the BOI will bear the expenses of the commission and finance divi-sion allocate necessary funds for the budget of the Board of Investment.

According to the notification, the commission will formulate a time-bound action plan specify-ing timeframe for implementing recommendations for a particu-lar sector.

The commission will give pri-ority to investment and trade and commerce-related reforms And in the regard, on a priority basis, the commission will submit some recommendations to the government within three/four months after the commission becomes functional, says the notification about terms and con-ditions guiding the high-pow-ered reform panel.

The working areas of the com-mission include- identifying all rules, bylaws, and government orders in force in Bangladesh identifying unnecessary rules, sub-rules and making recommend-dation for repealing those, exam-ining necessary rules and orders and identifying all complexities and procrastination created in abiding the existing rules.

Alos, the RRC tasks are prepar-ing recommendations for neces-sary reform of the existing rules and government orders to sim-plify those to remove foot-drag-ging practice and ensure due public services under the demo-cratic system of governance.

It also has to make recommend-dation for establishing a modern and dynamic administration suit-able to democratic system of gov-crnment. If necessary, recom-mendation has to be made for enacting new rules and regula-rions and government orders.

The commission has to take into consideration globalisation, regional cooperation and nation-al economic development in rec-ommending necessary reform of the rules and their clauses and orders related to investment, trade and commerce.

After finalization of recommend-dations in a specific sector, the commission instantly will submit these as partial recommendation, and before the end of the com-mission's tenure, it will place all the recommendations as compila-tion, the notification said.

If the commission feels the necessity of amendment, reform of the laws and enacting new laws in implementing the reform of the rules, clauses and government orders, it will refer to the Law Commission for accomplishing those dos, it further said.

The notification mentioned the style of work of the commis-sion. It can collect information from any government, semi-gov-ernment and autonomous and non-government offices, institu-tions and organisations, and the offices concerned, institutions and organisations will provide necessary cooperation as per demand of the commission.

The commission can hold dia-logue, exchange opinion with members of the civil society, offices concerned and organisa-tions as well as organise seminar, symposium and workshop for eliciting opinion before finalizing the recommendations, meant for recasting the overall polity.

Regarding investment, trade and commerce, the RRC can take advice of various development partners, including national regional and international organ-isations, the upcoming Bangladesh Better Business Forum and its working groups.

The commission can appoint local and external experts/con-sultants with the permission of the government and it can take financial and technical assistance from the development partners to run its functions.
